Generally, unless it is precluded by the declaration of bylaws for an association, there is no direct prohibition in the Illinois Condominium Property Act that would preclude an association from paying its directors for their service. However, any such compensation must be included in the bylaws and, normally, would require owner approval to make that change to the bylaws. It is not necessarily a best practice to pay board members for their service, but it may be appropriate in certain situations. An association should check with its counsel prior to attempting to amend any board member compensation provisions in to its documents to ensure that it is following required guidelines and doing so with the proper advice and guidance of an attorney.
