Tressler LLP litigators, Kathryn A. Formeller, Matthew J. O’Malley and Dillon Ellis, represented a condominium association regarding a complex breach of fiduciary duty dispute over a former Board’s decision-making related to capital expenditures. The matter was dismissed in the trial court but promptly appealed.  Serving as defense and appellate counsel, Kat, Matt, and Dillon successfully won the appeal filed by the plaintiffs. The appellate court affirmed the prior ruling for their client in this complex commercial litigation matter involving multiple parties.

Kathryn A. Formeller

Partner at Tressler LLP

Kathryn A. Formeller is a partner and Co-Chair of the Condominium & Common Interest Community Association Law practice. Her practice includes representing condominium associations and common interest community associations in a variety of areas, including rule enforcement, interpretation of governing documents, review and negotiation of contracts, and collection of assessments. Kat also provides advice to clients on their rights and responsibilities under the Condominium Property Act, Forcible Entry and Detainer Act, General Not for Profit Corporation Act and the Common Interest Community Association Act.

Kat also practices in the areas of insurance coverage analysis and litigation. Her insurance coverage and litigation practice primarily focuses on directors and officers liability, EPL, professional liability and fiduciary liability matters. Kat participates in commercial litigation nationwide and counsels insurers with respect to coverage issues associated with D&O, E&O, EPL and professional liability claims.

Matthew J. O’Malley

Matthew J. O’Malley is an attorney in Tressler’s HOA Practice Group and a member of the Diversity & Inclusion Committee. He has nearly a decade of experience and serves as general counsel to various HOA/condo associations, and advises his Boards and property managers on risk assessment, daily issues, and litigation strategies. Matt has a track record of success in both bench and jury trials. He focuses on the client’s resolution goals, whether that is achieved through trial, settlement conference, mediation or arbitration. Matt serves his clients in a variety of complex litigated and non-litigated matters, including actions for breach of contract, breach of fiduciary duty, indemnity and contribution, professional malpractice, community association law, personal injury, general corporate, employment discrimination and civil rights violations.

Dillon Ellis

Associate at Tressler LLP

Dillon Ellis is an associate in Tressler’s General Defense Litigation Practice Group. His practice centers on aviation litigation matters and involves a variety of practice areas, including premises liability, products liability and commercial disputes.

Prior to working at Tressler, Dillon worked as a research coordinator at an academic medical center while completing his master’s degree and preparing for law school. He clerked at Tressler throughout his time in law school before joining the firm as an associate. While clerking, he drafted pleadings, motions, written discovery and conducted research for the General Defense Litigation Practice Group. He also completed a contract negotiation internship with the research grants office at the University of Illinois.
