Generally, your condominium association likely has minimum bylaw terms in its declaration. In the event that it does not have minimum bylaw terms in its declaration, the Illinois Condominium Property Act Section 18 provides those minimum bylaw terms as a matter of law. The Illinois Condominium Property Act trumps either absent or nonconforming provisions of condominium association declarations. If your association does not have bylaws, it is a good practice to speak with an attorney about amending and restating your declaration in order to ensure that it complies with changes to the Illinois Condominium Property Act and contains necessary terms.
