What should associations do about unpaid assessments?

Condominium and homeowners associations have obligations to enforce the uniform collection of assessments from all owners. If owners fall behind and do not make regular payments towards their money assessment or annual assessment balance, which ever method the association uses per its declaration, then the board should institute a collection proceeding against the defaulting owner. This collection proceeding may proceed with the association filing a lien against the property and may also proceed with the association, in most cases, seeking eviction of the owner plus a dollar amount judgment for any unpaid assessments. Condominium properties and Common Interest Community Associations Act properties may recover their attorneys’ fees and costs toward the collection action, and many homeowners associations may also have provisions in their declaration that allow for the recovery of attorneys’ fees and costs.
