The Declaration establishes the association (whether a condominium or common interest community) and the By-Laws establish the obligations and duties of the association’s governing body – the Board of Directors/Managers.  Rules and Regulations supplement the Declaration and By-Laws by allowing the Board to adopt greater details of the association’s property and operations.  Did you know that Rules and Regulations require a different process of adoption than amendments to a Declaration?

Many of our clients have asked whether owners must be provided notice of proposed Rules and Regulations or whether owners must provide input and/or approval.  The answer depends on whether your association is governed by the Condominium Act or the Common Interest Community Association Act.
